Confusion as Appeal Court delivers 2 judgments on Anambra senatorial seat

Published by Tribune on Tue, 20 Dec 2011

Confusion nowtrails the issue oflawful candidate of the Peoples Democratic Party (PDP) in Anambra North senatorial district with the Court of Appeal in Abuja and Enugu divisions reportedly delivering conflicting judgments on the matter.Last Friday, the Abuja division of the court declared Lady Margery Okadigbo as the authentic candidate, while the Enugu division had, on Friday, August 19, dismissed her appeal seeking to be declared as the party's candidate for the April election into the Senate.A three-man panel, headed by Justice Samuel Oseji, alongside with Justices Amina Augie and Abdu Aboki of the Enugu division of the court, dismissed the case brought by Okadigbo. However, the Abuja division of the court, last week, headed by Justice M. U Mukhtar, held that Okadigbo was the candidate of the party. The court's judgment emanated from an appeal against the judgment of a Federal High Court which declared Senator Alphonsus Igbeke as the winner of the election into the senatorial district.Another claimant, Prince John Emeka, had challenged the high court judgment at the Court of Appeal. As of press time, all the claimants ' John Emeka; Alphonsus Igbeke and Lady Okadigbo ' are getting set to take the matter to the Supreme Court.Last week, a rights group, Society for the Rule Of Law in Nigeria (SRLN), called on the Nigerian Judiciary Reform Committee set up by the Chief Justice of Nigeria (CJN), Honourable Justice Dahiru Musdapher, to embark on a review of the conflicting judgments delivered by the nation's Court of Appeal to remove the present confusion in precedence of the court in dispensing justice to the people.
