Ogun PDP exco rejects dissolution

Published by Punch on Sat, 24 Dec 2011

The executive council of the Peoples Democratic Party, Ogun State chapter, has described the dissolution of the council and the composition of the Transition Reconciliation and Congress Committee to conduct party congresses in the state as illegal. The South-West zonal leadership of the party had announced the constitution of the ad hoc committee as a strategy to reconcile warring factions in the state PDP.The Ogun State chairman of the party, Chief Dayo Soremi, at a news conference in Abeokuta on Friday, however, argued that the committee could not overrule the state executive of the party. He said, "The intention of the South-West zonal executive to appoint an ad hoc committee to conduct congresses in Ogun State is, therefore, ultra vires. "It is tantamount to a suspension of the state executive committee, which by Article 12.37 (b) and (d) of the PDP constitution, is the only organ of the party with the power to conduct the congress of the party within the state."The chairman stated that it would negate Article 12.54 (b) of the partys constitution if the new composition was allowed to exist. He added, "The Alhaji Tajudeen Oladipo-led zonal committee has no power under Article 12.54(b), and the article does not empower a Zonal Executive Committee to set up ad hoc or standing committees to take over the functions of other organs of the party."The party leader pointed out that the zonal committee, led by Alhaji Oladipo, lacked the locus standi to dissolve the state executive council, saying that such power was exclusive to the partys National Executive Committee.Soremi recalled an injunction barring the PDP leadership from tampering with the state council, citing a judgement delivered by the Federal High Court in Suit No. FHC/L/CS/2248/11.He explained that the current state council had a four-year tenure, which began on February 28, 2008 and would end on February 27, 2012.
