RIM facing trademark dispute over BBM service

Just after losing the battle to name its next-generation software as BBX, Research In Motion is facing another trademark lawsuit, this time for the BlackBerry Messenger, cellular-news reported on Monday.A Canadian broadcasting trade company, BBM Canada said that its staff were often mistaken for RIM employees, and it sometimes took calls from customers having problems with their BlackBerry, and it had asked a court to order the company to stop using the BBM name.BBM Canada was founded in 1944 as a provider of trade information to the broadcasting industry.BBM Canada said that RIM had filed for a BBM trademark in October 2009, but was denied the request, although RIM said that the matter was still pending.In a statement issued to The Globe and Mail, RIM said: The services associated with RIMs BBM offering clearly do not overlap with BBM Canadas services and the two marks are therefore eligible to co-exist under Canadian trademark law.When asked about the BBM trademark matter earlier this month, RIM said it typically would not comment on pending litigation. The court hearing is set for January 11, 2012.
