Ex-Adamawa Speaker Loses Bid To Remove Successor

IT was a double tragedy for the embattled former speaker of Adamawa State House Assembly, Alhaji Ibrahim Sadiq Dasin, as he lost his motion on notice filed at the Yola High Court to remove his successor, the incumbent Speaker, Hon. Ahmadu Umaru Fintri, and his Deputy, Laori Kwomati.A two-page motion on notice filed by the counsel to the former speaker, Kanu Agabi, (SAN) was withdrawn by Ayo Akam, who represented Agabi after he bowed to a superior argument by counsel to the second defendant (Deputy Speaker), Innoncent Daa'agba and the counsel to the first defendant (Speaker) Leonard D. Nzadon.In the motion on notice, counsel to the plaintiff asked the court to grant an order of interlocutory injunction restraining Fintri and Kwamoti from holding themselves out or continuing to parade themselves as Speaker and Deputy Speaker, respectively, pending the determination of the substantive suit.Daa'agba told the court that based on order 47 rule (4) of the Federal High Court sitting rules, it was illegal for the presiding judge Justice Popo B. Lawi to sit over the case, pointing out that the court cannot sit on any matter until January 20, 2012 based on the provisions of the rules.Justice Lawi who agreed with Daa'agba's argument, told the counsels that he cannot sit on the case until January 20, 2012.When the counsel to the plaintiffs, Akam raised an objection that the case deserved urgent attention because of the closure of the Assembly, Daa'agba told the court that Akam lacks legal powers to bring the issue of closure of the Assembly complex before the court since he did not include it in his submission and prayers.Justice Lawi who granted Daa'agba's request to withdraw the motion on notice, advised counsels to both parties to seek amicable solution to the matter in the interest of the state and democracy.He adjourned the case to January 20, 2012 for hearing of the substantive case.
