Court fixes suit on fuel subsidy removal for Feb 21

A Federal High Court in Ibadan, Oyo State, has fixed February 21 for the commencement of hearing into the suit filed by a legal practitioner, Mr Kole Ajayi, in opposition to the complete removal of subsidy from petrol.Justice Jonathan Shakarho adjourned the suit till that day, as all the defendants in the case had filed necessary papers in the defence of the suit.Ajayi, in his originating summons, had listed the president, Federal Republic of Nigeria; the National Assembly and the Attorney-General of the Federation and Minister of Justice as defendants.In the originating summons dated November 23, 2011, Ajayi was praying the court to grant a declaration that the proposed removal of fuel subsidy by the first defendant (president of the Federal Republic of Nigeria) was illegal, unconstitutional, null and void, as it was against good governance and public policy and against the economic interest and well-being of the good people of Nigeria.He was also seeking an order of perpetual injunction restraining the defendants, their servants, agents and or privies from implementing or ratifying the removal of the fuel subsidy.
