Ago Oja: Baale approaches Appeal Court 'To restrain Ajimobi, Alaafin, others

Published by Tribune on Thu, 10 May 2012

AS reported by the Nigerian Tribune that the chieftaincy tussle between the Baale of Ago Oja in the ancient Oyo town, Alhaji Ganiyu Busari and the Oyo State government was playing out like an episode in a soap opera, the traditional ruler has approached the Court of Appeal Court sitting in Ibadan, for an order to restrain the state government or its agents from ejecting him from his palace.A motion on notice and ex parte application marked HOY/46/2006, dated May 7, 2012 and filed by his lawyer, Biodun Abdul-Raheem, also joined the Alaafin of Oyo, Oba Lamidi Ade-yemi and the Attorney-General of the state, Mutalab Ojo, as respondents in the motion. The Baale also pray-ed the court that the respondents be restrained from taking further action whatsoever pursuant to the judgment of High Court of Oyo State by Justice S. Olu Akinola in suit No. HOY/46/2006, delivered on July 31, 2007.The 2007 verdict of the lower court ordered the Baale from parading himself as such, because the title of Alago of Ago Oja did not exist in history. He had appealed the judgment and the court had adjourned, ordering parties to abide, pending the determination of the appeal.Busari's lawyer, Abdu-Raheem, noted that neither the state government nor the Alaafin had appealed the decision of the Appeal Court, until the issue of letter seeking to eject him came suddenly.Allegedly in responding to a petition by the Alaafin, the state government had caused the Commissioner for Local Government and Chieftaincy Matters, Mr Peter Odetomi, to ask Busari to vacate his palace and cease from parading himself as the Alago of Ago Oja.
