Court annuls dissolution of OYSIEC

A High Court sitting in Ibadan has declared unconstitutional, null and void, the purported dissolution of the Oyo State Independent Electoral Commission (OYSIEC) by the Oyo State government on June 2, 2011 and declared that the dissolved members are entitled to continue functioning as officers in their various capacities until September 5, 2012.The judgment was delivered by Justice M.O. Bolaji-Yusuff on May 24, 2012 in a suit number 1/663/2011, filed by Mr Olasunkanmi O. Olaleye, Alhaja Falilat Titilayo Akande, Alhaji Boladale Hassan, Mr Liadi Agbaje and Mrs Christiana E. Thomas against the governor of Oyo State, the attorney general of Oyo State, the Speaker of Oyo State House of Assembly and the Head of Service, Oyo State. He also granted a stay of execution of the judgment delivered by the court on February 2, 2012.Justice Bolaji-Yusuff ruled that 'It is hereby declared that the purported dissolution of the Oyo State Independent Electoral Commission pursuant to the resolution of 13 members of the House of Assembly on 2nd June, 2011 is unconstitutional, null and void and no effect. It is hereby declared that the claimants are entitled to continue in their offices as the chairman and members of Oyo State Independent Electoral Commission until 5th September, 2012. The claimants are entitled to their salaries and allowances until 5th September, 2012 including their salaries and allowances throughout the period of their purported removal.'But the defendants sought for an order staying the execution of the judgment pending the determination of the appeal filed by the applicants which came in an 11-paragraph affidavit.
