Members drag body of surveyors and valuers to court over expulsion

Two members of the body of Estate Surveyors and Valuers, Mr. Daramola Olutoye and Emmanuel Osita Okoli, have dragged the body to a Federal High Court sitting in Abuja challenging their expulsion from the body.Joined as respondents are, The Registered Trustees of the Nigerian Institution of Estate Surveyors and Valuers (NIESV),Estate Surveyors and Valuers Registration Board of Nigeria (ESVARBON) and one Mr. Bode Adediji as first to third respectively.The applicants through their counsel, A.N.C Ikoro had approached the court via motion ex-parte praying for the leave of the court to apply for an order of certiorari, removing the two motions dated 11/3/2011 and 12/3/2011 respectively, containing the purported grounds which the 1st and 3rd respondents relied on for the purported expulsion of the applicants published in various Nigerian newspaper and magazines into the Federal High Court for the purpose of their being quashed.They further sought for a stay and abatement of any embarrassment from the respondents pending the final determination of the substantive application.In a 34-paragraph affidavit deposed to by one of the applicants, Daramola Olutoye, he averred that he was a bonafide financial member of the association having paid his dues up to 2011 adding that he had also paid the renewal fees both for himself and  his firm.Olutoye also averred that the second applicant had contested with the third respondent for the position of the president during the annual conference of the association which took place in Kaduna in March this year, adding that he had queried the activities of the third respondent by approaching the court to interprete certain questions which were bothering his mind.He added that the court refused to grant the prayers and such dismissed it, stating that consequently the 1st and 3rd respondent concocted a motion, purportedly proposed his expulsion and quickly summoned a meeting of council members and proposed his expulsion but the council refused arguing that the matter be referred to a committee set up for the purpose of investigating such matters.The deponent further stated that, to my surprise and shock, two motions were moved seeking our expulsion from the association on Saturday, 12/3/2011. I was not given any notice of the said motions prior to my attending the annual conference.
