100 Akute landlords head for Court of Appeal over land ownership

Over 100 landlords living in old Akute road, Iju, Lagos, have approached the Court of Appeal sitting in Lagos, to ask for a stay of execution of a judgment awarding the ownership of the vast land to one family known as Lisboa Family.In a Motion on Notice filed by their counsel, Mr. Kabir Akingbolu, the landlords represented by four members namely Jonah Ojike, Mrs. Rita Edero, Mrs Yetunde James and Mr Adeyemi Kolawole, prayed the court to stay execution of the judgment earlier delivered by a Lagos High Court and confirmed by the appellate court on the ground that their interest will be adversely affected if the judgment was implemented.According to the landlords, they purchased their piece of land from the defendants' family known as the Obawole family years back and the family members were interested parties who were supposed to be put on notice while the actions in the trial and appeal court were being heard, but suddenly got wind of the judgment when the winner of the case was about to implement the judgment of the court.To this end, they are asking the appellate court to grant them leave to appeal as interested party against the judgment of the lower court delivered nine years ago as well as an order extending time within which they can seek the leave of court to appeal against the said judgment.They claimed that they bought and paid for the lands which they built their houses over the years and they only became aware of the dispute over the land for the first time on July 3rd, 2012 when some group of people sent by the respondents came to paste a notice to forcefully eject them from their various houses on the land.And they therefore, are depending on the court to remedy the situation.
