Imo West senatorial seat: Supreme Court sacks Izunaso, enthrones Uzodinma

The Supreme Court,on Thursday,sacked Senator Osita Izunaso from occupying the Imo West senatorial seat, just as it declared Chief Hope Uzodinma as the authentic candidate of the Peoples Democratic Party (PDP) for the election.PDP had earlier won the April 9 National Assembly election, with Izunaso as the candidate.In a unanimous judgment, the apex court set aside the judgment of the Court of Appeal, which had earlier affirmed the decision of Justice Abdul Kafarati of a Federal High Court sitting in Abuja that Senator Izunaso was the candidate of the party for the senatorial seat.Justice Walter Onno-egen, who read the lead judgment, however, said the court would give reasons for its judgment on May 20.The appellant, Uzodin-ma, had earlier approached the apex court, praying it to set aside the judgment of the lower court.Counsel for the appellant, Chief Wole Olani-pekun, who led the team of four other Senior Advocates of Nigeria, contended that the lower court failed to consider all the evidence placed before it before arriving at its judgment.Besides, he said his client was not given sufficient time to present his case, as the time accrued to him by law was abridged by the court.Counsel for the PDP, Chief Olusola Oke, agreed with Uzodinma, when he told the court that the appellant was the authentic candidate of the party and not Izunaso.
