Wanted list: Tokyo's lawyer writes Oyo CP

Counsel for the court-reinstated chairman of the National Union of Road Transport Workers (NURTW) in Oyo State, Alhaji Abdul Lateef Akinsola popularly known as Tokyo, Dr Fatai Bello, has written the state Commissioner of Police, Mbu Joseph Mbu, over the command's insistence that the union leader is still on the wanted list of the Nigeria Police.The counsel, in a letter dated September 19, 2012 with the caption 'Re: Suit No. NIC/LA/IM/2009 Alhaji Lateef Olanrewaju (branch chairman, Lagelu Mini Bus) of NURTW Oyo State chapter & 13 others vs Alhaji Lateef Salako a.k.a. Eleweomo & 1 and Suit No. FHC/IB/CS/95/2011 Alhaji Lateef Akinsola vs the Inspector General of Police and Commissioner of Police, Oyo State, and made available to newsmen in Ibadan on Sunday, said that the union leader was no more on the wanted list of the police.The letter was received at the Commissioner of Police's office on September 19, 2012 and was copied the Inspector General of Police and the Assistant Inspector General of Police, Zone 11, Osogbo.'By virtue of the ruling of the Federal High Court on 20th December, 2011, your office and office of the Inspector General of Police must first seek and obtain leave of the Federal High Court befor eoyu can arrest our client. The said judgement is still and there is no appeal over it,' he declared.Apparently reacting to a report that the the state Commissioner of Police had summoned Tokyo and Mr Lamidi Mukaila a.k.a Auxiliary over their alleged roles in the killing in Ibadan, claimed that he was acting for the Tokyo, 'the current chairman of NURTW in the state.''From the content of the report, it does appear that your immediate past predecessor did not brief you properly on the true position of NURTW in the state as at the time he was redeployed or you are economical with the truth of the matter for reason best known to you,' he said.The counsel referred to a letter dated, 21st March,2012 and received in the Commissioner's office, 'wherein we informed your office of the position of the suits and attachedf therein certified true copies of the said judgments of the court relating to this matter.'According to him, the office of the Attorney General and Commissioner of Office, Oyo State, deposed to an affidavit in suit no. FHC/IB/CS/95/2012 to the effect that 'your office was aware of the judgment delivered by the Federal High Court on 20th December 2011 and yoy were not cotemplating the contravention of the order made by the court in that case.While quoting the police boss as saying that 'the police would not be deterredf by the frivolous court order they brought to the police', he described it as flagrant abuse of office.He urged the police boss to take notice that the law did nto contemplate or provide a situation where a Commissioner of Police would sit as a appellate court over a Federal High Court exercising judicial functions.
