Kogi not among states for fresh PDP primary election -Court told

A Federal HighCourt sitting inAbuja has been told that the order of fresh primary elections by the Independent National Electoral Commission (INEC) for the five states which were yet to conduct governorship elections, did not involve Kogi State.This claim was contained in an affidavit in support of motion on notice filed by a chieftain of the party in the state, Umar Lawal, who was a state delegate to the state congress of the party held between January 4th and 9th, 2011, which was organised for the election of Peoples Democratic Party's candidates for the national and state legislative houses and the governorship primary election.The six-paragraph affidavit was deposed to by Udo Unogu, in support of Lawal's suit challenging the fresh primary election conducted by the ruling party in Kogi State last Thursday.The court presided over by Justice Bilikisu Aliyu had already granted leave to the applicant to bring his motion seeking to compel INEC to retain in its records the name of Alhaji Jubrin Isa Echocho as the candidate of the PDP for the forthcoming Kogi state governorship election, having won the 9th January, 2011 primary election in the state.The motion could not be moved,on Monday, with a court staff revealing that the case file had been returned to the Chief Judge of the Federal High Court for reassignment to a new judge since the suit was a vacation case.It was further learnt that all the vacation cases had been returned for the re-assignment since the new legal year had commenced.
