Accord Party's petition to CJN baseless ' Senator Adeseun

Published by Tribune on Fri, 30 Sep 2011

The senator representing Oyo Cen tral senatorial district of Oyo State, Senator Ayoade Adeseun, has responded to the petition sent to the Chief Justice of Nigeria (CJN) and the National Judicial Council (NJC) by Chief Oyebisi Ilaka of the Accord Party, on the judgment of the appellate court.According to Michael Lana, counsel for Senator Adeseun, the petition was frivolous and, as such, should be disregarded by the CJN and NJC.In his rejoinder, addressed to the CJN and NJC, the counsel noted that 'instead of confessing his indolence and lack of knowledge of election matters, the counsel has resorted to intimidation of counsel and judges of both the lower tribunal and the Court of Appeal.'He expressed his dissatisfaction on the 'unethical behavior of the counsel, who took the case apparently without averting his mind to both the 1999 Constitution as amended and the Electoral Act 2010, as amended.'The petitioner had alleged that in the process of hearing the petition, the judges deliberately misread and altered a phrase in his affidavit, in order to shut him out from making any argument. To this, Lana noted that 'rather, it was he who filed an incompetent petition before a tribunal, unknown to law,' adding that when he was asked to make amendments before 48 hours, he failed to comply with the order. He went on further to describe the manner in which the counsel for Chief Ilaka had handled the case from its inception, noting that it revealed his 'sloppiness and trickery.
