Alleged terrorist negotiator Mamu files fresh bail application

<img src="https://dailypost.ng/wp-content/uploads/2023/06/Tukur-Mamu.jpg">The Federal High Court in Abuja has fixed July 22 for the hearing of a fresh bail application filed by Mr. Tukur Mamu, the alleged negotiator in the Abuja-Kaduna train kidnapping case, who is facing a 10-count terrorism charge.Mamu, represented by a legal team led by Senior Advocate of Nigeria (SAN), Mr. Johnson Usman, is seeking release from the custody of the Department of State Services (DSS) to enable him to receive urgent medical treatment. The defendant told the court that his health had deteriorated significantly and that he required surgery.However, the Federal Government, through prosecution counsel Mr. David Kaswe, opposed the bail request. In a counter-affidavit, the government argued that Mamu posed a flight risk and reminded the court that a previous bail application had already been denied. The prosecution also stated that the DSS has sufficient medical facilities to attend to the defendant's health concerns and cited the gravity of the terrorism-related charges as a reason to keep him in custody.Presiding judge Justice Muhammed Umar adjourned the matter to July 22 to allow both parties to present arguments on the application.The Federal Government had on March 21, 2023, arraigned Mamu for allegedly aiding terrorist activities. He is accused of collecting ransom payments in various currencies from the families of victims of the Abuja-Kaduna train attack on behalf of Boko Haram. According to the charges, Mamu allegedly received a total of $420,000 and 21 million, and concealed these funds in his Kaduna residence.The charge sheet, signed by Director of Public Prosecution Mr. M.B. Abubakar, also accused Mamu of exchanging voice notes with a known Boko Haram spokesperson, Baba Adamu, in connection with terrorist activities. These actions, the government claims, constitute violations of the Terrorism Prevention and Prohibition Act, 2022.Mamu was arrested on September 6, 2022, in Cairo, Egypt, while en route to Saudi Arabia with his family for the lesser Hajj. He was repatriated to Nigeria and has since been held in DSS custody under a detention order.In an affidavit, DSS operative Hamza Pandogari told the court that Mamu used his role as a journalist to mask his alleged collaboration with terrorist groups. The DSS claimed that Mamu was intercepted by Interpol while heading to a secret meeting with terrorist commanders.The self-acclaimed Kaduna train negotiator exploits the opportunity to perpetrate, aid and abet as well as render support to both local and international terrorist organisations, the DSS stated.According to the DSS, a search of Mamus home and office led to the recovery of numerous incriminating items, including cash in various currencies, foreign coins, 16 ATM cards, seven cheque books, six laptops, four tablets, 24 phones, three international passports, a firearm licence, and military uniforms.Mamu pleaded not guilty upon his arraignment. On April 27, 2023, the court denied him bail and also rejected a request to transfer him to Kuje prison. He alleged that the DSS failed to comply with an October 31, 2023, court order granting him access to his personal doctor. He claimed he had only been allowed one medical visit, during which a surgical recommendation was submitted, but he has not been allowed further treatment since.Mamu warned that his health has continued to decline and that he may lose his life without adequate medical intervention. He assured the court of his willingness to appear for trial if released.The court, however, maintained that its refusal to grant a transfer to Kuje prison was based on the prevailing security situation and an increase in jailbreaks across the country.
