JAMB retiree sues bank over disappearance of N18m from account

A retiree of the Joint Admissions and Ma-triculation Board (JAMB), Dr Thomas Ndayiye Kolo, has dragged the Union Bank of Nigeria Plc before Justice Isa Aliyu of Kaduna High Court, over an alleged fraudulent withdrawal of over N18 million from his account domiciled in the the Kaduna branch of the bank.He had been granted an ex parte application by the court to file and serve the writ of summons, statement of claim and other court processes out of the jurisdiction of the court and in its Lagos office, located at Stallion Plaza, 36, Marina, Lagos.The plaintiff was asking for, among others, a declaration that hem having not authorised the withdrawal of the sum of N18,220,000 from his Account No: 0020230860 domiciled at the Kaduna branch of the defendant, was entitled to the credit balance of same with the accrued interest to date.He was also asking for a declaration that the defendant was liable for the refund of all un-authorised withdrawals made from the account via cheques nos: A/900, 9019, 90020, 921 and 90024, which were different in form and style of cheques issued by the defendant to the plaintiff for the purposes of making withdrawals from account No: 0020230860.He was also asking for N20 million as general damages and N250,000 as cost of filing the action.In his statement of claim, Kolo averred that 'before giving value to any cheque issued to a third party, thebank usually call me for confirmation of such payment via telephone no: 08033147901 submitted to the bank,' adding that no confirmation of payment was made by the bank in respect of the subject matter of the suit.The defendant, in a letter dated November 2011, signed by its Regional Business Development Manager, A. S. Tahir, however, said it had commenced investigation into the alleged disappearance of the retiree's deposit.
