Lagos: ACN appeals election tribunal judgment

The Action Congress of Nigeria(ACN), Lagos State chapter and Mr Adewale Adeniji of Ikoyi/Obalende Local Council Development Area (LCDA) have expressed their dissatisfaction with the October 4 verdict of the Local Government Election Petition Tribunal that sat at Ikeja Magistrates' court by filing an appeal against the judgment.The appeal against the judgment of Justices D. Akinsanya, P. Ojo, Demi Ajayi Etti and Dave Ajetunmobi was filed on four grounds.The respondents in the case are Babajide Obanikoro, Peoples Democratic Party (PDP), Lagos State Independent Electoral Commission (LASIEC) and 160 others.ACN complained about the whole judgment of the tribunal on the grounds that the judgment is against the weight of evidence adduced at the hearing of the petition.The party also held that the tribunal erred in law when it held that the collated ward results tendered by the respondents could not be ascribed any value.It also stated that the tribunal misdirected itself when it held that the second respondent's final address and reply were not properly filed before it and struck them out.ACN also stated that the lower court misdirected itself when it held that the uncontroverted evidence of the respondents' witnesses could not be ascribed any probative value.The party also asked for an order allowing the appeal and the setting aside of the judgment of the tribunal.
