Adamu re-appointed Ag PCA

THE fate of the suspended president ofthe Court of Appeal, Justice Ayo Isa Salami, appears sealed with the renewal of the appointment of Justice Dalhatu Adamu as the acting president of the court for another three months.Sunday Tribune had exclusively reported that the Chief Justice of Nigeria (CJN), who also heads the National Judicial Council (NJC), Justice Dahiru Musdapher, had written to President Goodluck Jonathan on the expiration of the first three months of Adamu's acting presidency.The media consultant to the CJN, Mohammed Adamu, confirmed the development on Tuesday, noting that Adamu was nominated for re-appointment by Musdapher.With the re-appointment of Adamu, it appeared that all hope had been lost for Salami, who was suspended by the NJC for misconduct.He is still in court challenging his suspension, though there were confirmed moves for political resolution of the controversy created by his ouster.The 1999 Constitution allows for three months in acting capacity for the office, renewable for just another three-month term.It was learnt that Adamu's name may be forwarded to the Senate for confirmation in substantive capacity before the expiration of the second three-month mandate.Dalhatu was appointed in acting capacity on August 21, 2011 by Jonathan, after the NJC communicated the suspension of Salami to him, in accordance with the dictates of the constitution.The first three month mandate ended on Tuesday.The letter to the president seeking an extension for Adamu was from the NJC which CJN heads.A source had told Sunday Tribune last week that Adamu got an extension.During the confirmation session of Musdapher at the senate as the substantive CJN, Senate Leader, Victor Ndoma Egba SAN, had disclosed that Jonathan would be sending Adamu's name for confirmation as the substantive PCA, by the senate.The confirmation session was yet to take place.A source noted that Adamu's ailing health might be responsible for the delay.It was learnt that Jonathan had earlier forwarded his name for confirmation but the senate allegedly returned it for re-wording to avoid legal pit-falls due to the circumstances surrounding Salami's exit from office.Adamu is reportedly suffering from chronic diabetes.He was once admitted at the National Hospital in Abuja after his resumption in office.He was said to have received treatment also in Egypt.Musdapher and Adamu almost had a collision over the controversial sack of Borno State Governorship Election Petition Tribunal by the latter, a few minutes to the delivery of its judgement.A directive to reinstate the tribunal by Musdapher was promptly obeyed by Adamu.
